The use of the web site www.drosa.com and the services and products contained in it implies the acceptance by users of the General Terms and Conditions and usage regulations as set out in the last updated version, and it is therefore important for users to read them every time they visit the site, along with all the specific conditions relating to each product or service, which must also be accepted.

The General Terms and Conditions are aimed at regulating the use of this website, as well as the services that it provides. Doña Rosa Bungalows SL reserves the right to modify, add or eliminate part of these conditions at any time and to make changes in the products and services within this site without prior warning. Please check periodically for possible changes.

This website is limited to personal and not commercial use. Any individual that uses this website will automatically be considered a User and will be deemed to have fully accepted all terms and conditions, and as such commit to using the website and its services in abidance with the law and these general terms and conditions. The User agrees not to use this website and its services illegally, contrary to these general terms and conditions, rights and interests of a third party, or in a way that might interfere or damage it. The User agrees to not impede the access of other users to this website by not downloading any of its contents, that being texts, graphics, drawings, sound data, pictures or photographs, videos, software or any other kind of material through which its services are provided, as well as not doing any actions that may damage, interrupt or generate errors in the system. It is forbidden to modify, copy, distribute, transmit, reproduce, publish, advertise or sell the contents of these web pages or carry out any other activity with them, even if the sources are given, without the written consent of Doña Rosa Bungalows SL. 1.- Doña Rosa Bungalows SL accepts no responsibility for damages deriving from access to, use or misuse of the contents of the website. All the information provided through this site is provided 'as such', with no guarantees of correct visualization, downloading or functioning of elements and content or information on the website that could be altered, interrupted and made not to function due to factors or circumstances out of Doña Rosa Bungalows SL control. Specifically, Doña Rosa Bungalows SL does not assume any responsibility for damages, prejudices, losses, grievances or costs produced by: (i) interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages and electrical system disconnections brought about by deficiencies, power surges, errors in the line or telecommunication networks or for whichever, other associated cause which is out of the control of Doña Rosa Bungalows SL; (ii) illegitimate interference through the use of malignant programs of any type and means of communication, such as computer viruses or similar; (iii) inadequate or unlawful use of the www.drosa.com website; (iv) security or navigation errors due to the poor functioning of the browser or through the use of outdated versions of the browser. The User hereby relinquishes any claim against Doña Rosa Bungalows SL proceeding from the use of this site or any other information available on it. Use of this web site is undertaken at the User's own risk.

2.- Doña Rosa Bungalows SL is not responsible for the content, information, opinions or statements belonging to third parties who communicate, exhibit or transmit them through this website.

3.- Bungalows Doña Rosa SL is not responsible for the information and content integrated in spaces and web pages belonging to third parties accessible via links, hyperlinks or directories, whose presence on the website has a purely informative objective. In no way is this a suggestion or recommendation to utilize any of the web spaces or pages. Nor is Bungalows Doña Rosa SL responsible for the information and contents of any website presented by third parties that appear under the name or logos of Bungalows Doña Rosa SL.

4.- In such cases where Bungalows Doña Rosa SL allows third parties to use this website to advertise or provide their services, Bungalows Doña Rosa SL will not be held responsible for preparing the general and legal terms and conditions regulating the use, provision or procurement of such services from third parties. 6. - Except when the User makes an online reservation, in which case they are regulated by this document, the simple use of this website does not result in a contract, commitment or work relationship between Bungalows Doña Rosa SL and the User. Any right not expressly granted to the User is expressly reserved for Bungalows Doña Rosa SL.

7.- Bungalows Doña Rosa SL provides the contents and all information in good faith, and makes no guarantee of absolute accuracy and update of data and texts, however every possible effort will be made to ensure it.

8.- The User is deemed responsible for all complaints or legal action from third parties against the website which have occurred due to the User's employment of it, and as such will also be held responsible for all negative consequences.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All the contents, elements and information accessible by the User via the website are subject to the laws pertaining to intellectual and industrial property, patents, and copyrights held by Bungalows Doña Rosa SL or third parties subject to the same laws that have been licensed to Bungalows Doña Rosa SL. PRIVACY POLICY AND DATA PROTECTION

ANONYMOUS NAVIGATION

Bungalows Doña Rosa SL only obtains and conserves the name of the domain of the ISP provider and/or the IP address used for accessing the Internet, the Internet address that directed the User to the link of our website, the date and time our website was accessed and the number of daily visitors to each section. This data is analysed so as to collect information/ statistics about servers and countries which visit our website.

This website uses cookies, small information files which are generated on the User's computer and which allow the collection of information about the hour and date that the User last visited the website, the areas of the website which the User visited, and the security elements that permit the control of access to restricted areas. These small information files are linked to a User anonymously and do not permit the access to personal information nor any information from any harddrive of the User's computer. The User has the option of denying the use of cookies, by selecting this option in his/ her browser. Nevertheless the company states that the disablement of the latter may impede optimum operation of the page.

PROTECTION OF PERSONAL INFORMATION

In accordance with the Organic Law 15/1999 on the Protection of Personal Data, Bungalows Doña Rosa SL informs its Users of its policy.

As is stated in the Organic Law 15/1999 on the Protection of Personal Data, Users have at all times the right to access the file where their data is stored, and may exercise their right to rectify, cancel and oppose said data. Likewise they have the right to revoke consent for the cession and treatment of their personal data.

The User consents to and accepts, expressly and unequivocally, that their personal details collected during registration or reservation will be part of data files held by Bungalows Doña Rosa SL, with the purpose of providing the requested services, for the correct identification of Users who request personalised services and to facilitate the management of administrative tasks. Furthermore, this data will be used to facilitate information, via email or any other medium, of the products and services offered by Bungalows Doña Rosa SL. In the case of commercial information, the User expresses their consent to being sent advertising via email or any similar medium.

In any case, Bungalows Doña Rosa SL agrees to the compliance of its obligation to secrecy of data of a personal nature and of its obligation to treat them as confidential, and assume, to this end, the technical and organizational measures, and security necessary to avoid the alteration, loss, treatment or unauthorized access, in accordance with that established in the applicable legislation.

The User gives their consent to Bungalows Doña Rosa SL to share this data with other companies in the group, with the purpose being the same as stated above, under the same conditions and always respecting the Spanish legislation on data protection of a personal nature.

Any registered User can at any time exercise their right to access, rectify and delete their provided personal details and/or revoke their consent to treatment and cession of their data, as is laid down in Organic Law 15/1999 on the Protection of Personal Data and in accordance with the legal procedure established. To do so, the User can send their written petition to Doña Rosa Bungalows SL, Avenida de Alemania 57, … San Bartolomé de Tirajana, Provincia de Las Palmas, España, indicating with the words "Modification/Rectification/ Cancellation of Personal Details". This petition must include name, surnames, a photocopy of the identification document, and the actual request to cancel and/or rectify and/or modify, date and signature.

GENERAL CONTRACTING CONDITIONS

The use of any services offered by Bungalows Doña Rosa SL implies the User's complete acceptance and validity of the general terms and conditions set out in this document, as well the acceptance of and agreement to the following contraction and booking conditions. They are considered to be automatically incorporated in the agreement entered into with Bungalows Doña Rosa SL, without the need for them to be expressly written in said agreement.

The online reservation of bungalows implies the direct booking of bungalows through this website, as well as consent to the reservation and confirmation. Accordingly, once the electronic process of reservation has concluded, the reservation is confirmed, and as such the client will need to provide their personal details (Name and Surname, Address, Post Code, City, Country, E-mail address and Telephone Number ) and credit card details (Type of card, Credit card number, Security code and expiry date).

By using this service and once all necessary details have been provided, the reservation will be confirmed on the website, with all the details of said reservation, and a copy will be sent to the e-mail provided.

Through acceptance of this contract, you declare and accept:

1.- That you are of age (over 18 ) and have the necessary legal capacity to contract the services offered on the Bungalows Doña Rosa SL website;

2.- That you fully understand all the contracting conditions and general terms included in this document;

3.- That all the information supplied on registering is true, complete and concise;

4.- That access to the web is exclusively the Users responsibility. The contents, commercial activities, products and services included in the web site are not conceived or directed to those persons who reside in districts where their contents are not authorised;

5.- That the reservation is confirmed once the electronic booking process is complete, and that this implies the reservation of accommodation in the Bungalows Doña Rosa complex;

6.- That you confirm the dates given in the reservation, as well as the number of rooms and people;

7.- That only the pages featured on the web map are included on the website;

8.- That the conditions and price of the contracted reservation are those expressly determined in the confirmation document, with Bungalows Doña Rosa reserving the right to modify the price in the case of errors and with previous notification of the Client;

9.- That all card details are correct;

10.- That the electronic reservation process implies charging 20% of the total price of the reserved and confirmed accommodation to the credit card that has been provided. This is charged as a pre-payment of the reservation, and only in the case of cancellation conditions not being met will this be considered compensation for Bungalows Doña Rosa.

11.- That the remaining 80% of the reservation will be paid upon arrival at the Bungalows Doña Rosa complex. The reservation will be kept until 18:00 on the day of arrival. If the customer does not check-in before this time, Bungalows Doña Rosa is free to give the reserved bungalow to another person and reserves the right to keep the 20% previously charged as compensation.

12.- That the reservation may be cancelled with no penalty:

• for accommodation between the 01 August and the 30 April, when notified at least thirty days before the day of arrival;
• - for accommodation between the 01 May and the 30 July, when notified at least 15 days before the day of arrival.

If notified within the specified time, Bungalows Doña Rosa SL will reimburse the amount paid. If the there are any extra charges due to bank transactions, they will be charged to the Client's account.

To inform of a reservation cancellation, written notification should be sent to drosa@drosa.com, with the heading "Cancellation of Reservation". All personal and reservation details should be included in the email. Cancellations can also be made via telephone through the information and reservation phone number given on the website.

13.- That the price specified only includes accommodation, and does not include any other service that is not expressly featured in the reservation;

14.- That the User accepts that the legislation applicable to the functioning of this service is Spanish legislation and submits to the jurisdiction of the Courts of Las Palmas de Gran Canaria for the resolution of any divergences arising from the interpretation or application of these clauses.

15.- That on the day of departure the Client must check-out of their bungalow no later than 12:00 (12pm). Any later than 12:00, and the Client may be charged an extra night;

16.- That all the offers will only be valid for the period of time during which they are accessible to recipients of the service for effective contracting via the system established on this website;

17.- That the personal details provided when doing the reservation belong to the User, who permits and consents to Bungalows Doña Rosa SL entering them into their information database (in its electronic or non-electronic format), which is administered as established under the law and stated in the 'Protection of Personal Information' section of this document;

18.- In the event of Bungalows Doña Rosa communicating the cancellation of the reservation due to reasons beyond its control, which are understood to mean those that are uncontrollable, abnormal and unforeseeable, the consequences of which could not have been avoided in spite of having acted with due diligence, the reservation will be cancelled and the Client will have no right to any claim or compensation. The Client will have the right to claim the reimbursement of the 20% paid at the time of making the on-line reservation, which Bungalows Doña Rosa will refund even in cases where no such claim has been made.

LEGISLATION AND JURISDICTION

These general terms and conditions, as well as the relationship between Bungalows Doña Rosa SL and Users, are subject to the provisions of Law 7/1998 of 13th April on General Contracting Conditions, to Law 26/1984, of 19th July, General Law for the Defence of Consumers and Users, to Law 7/1996, of 15th January, on Retail Commerce Regulations, to Royal Decree 1906/1999, of 17th December, regulating Telephonic or Electronic Contracting with general conditions, Organic Law 15/1999 on the Protection of Personal Data, Royal Decree 994/1999, of 11th June, which develops said organic law, and Law 34/2002, of 11th July, on Services of the Information Society and Electronic Commerce and in a subsidiary fashion to the Civil Law and Commerce Law.

For the resolution of any divergences arising from the interpretation or application of this legislation, Bungalows Doña Rosa SL and the User submit to the jurisdiction of the Courts of Las Palmas de Gran Canaria, province of Las Palmas, Spain.
